Conditions of Use1. Preamble(1) All offers by „choosyfish" are made on the basis of below general terms and conditions. The termsand conditions form the basis of all quotations and agreements and shall be deemed to be acknowledged by the placement of an order or the acceptance of a delivery for the duration of the total business relationship. Any deviating which have not been expressly agreed shall be non-binding for us even if not expressly contradicted by us. (2) The validity of these terms remain unaffected by the invalidity of any individual conditions. 2. Conclusion of a contractThe contract shall be deemed to be concluded by the confirmation of the order, if we accept the order by delivering the good or notifying about the delivery. 3. Refusal of orderschoosyfish is at liberty not to accept online orders. The decision is at the discretion of choosyfish. The ordering party will be immediately informed about the non-execution of an order. 4. Reservation of proprietaryUntil payment has been completed, the goods remain to the property of choosyfish. 5. Terms of payment(1) The prices that are valid at the time of the order placement are applicable. All prices include the current legal VAT. (2) Payment of the goods may be either settled by credit card, advance payment, against invoice for existing customers, and in Germany also COD (cash on delivery). We reserve the right to exclude certain types of payment in individual cases. (3) If delivery is made against invoice, you will be obliged to settle the amount due within 14 days after receipt of the goods. In the event that individual goods are returned, you may deduct the corresponding sum from the total amount of invoice. If payment is made on delivery (cod), the purchase price of the returned goods will be reimbursed (without the delivery fees). In such case, we need your bank details. (4) In the event that you delay payment, choosyfish reserves the right to charge you reminder fees. Moreover, should you ignore our payment reminder, we ewll pass on the payment request to a commissioned debt collection agency. The collection cost include reimbursement claims concerning aspects of procedural law, all out-of-court costs of a commissioned collection agency and a commissioned lawyer. 6. Delivery(1) We deliver free-of-charge from an order value of 100.00 Euro within Germany, by DPD or Hermes while stocks last. Delivery time usually is 3-5 work days from the date of the order placement. (2) The indicated dispatch flat rates do only apply for deliveries within Germany. For deliveries into other countries, choosyfish refers to the detailed description on the delivery terms page. (3) All details made regarding the delivery time are non-binding unless the delivery date had been expressly confirmed. 7. Transfer of risksThe goods are delivered at the buyer`s risk. The risk is transferred to the customer upon handing over the goods to the forwarding company. Above said shall also apply if choosyfish has taken over the transportation costs. The customer must claim complaints due to transport damages (e.g. damaged packing upon receipt of goods) directly with the forwarding company within the designated deadlines. 8. Free right of return(1) German purchaser may return all articles you purchased from the choosyfish online shop free of charge within 14 days; without indicating any reasons. The return period starts no sooner than upon receipt of the goods. Sending the goods in due time is sufficient proof of observance of the period. For returning the goods we would like you to drop it at your nearest post office or send it by Hermes S package and we will transfer you the money back to your account. (2) Please note that returned goods - within the return period of 14 days - may be used for test purposes only - as would be common use when trying the goods on in a retail store - and must be returned with the original label, original packing and return shipments label. (3) In case that the goods, upon return, should show traces of use or damage, we reserve the right to claim reimbursement. 9. Reservation of proprietary rights(1) Until expressly otherwise agreed, the statuory warranty regulations are applicable. (2) If the customer is a businessman in the sense of the German Commercial Code, we reserve the right of property of all delivered objects until receipt of all payments due under the business realtionship. 10. Data protection(1) Personal data of the ordering party that are required to handle the business, such as name, address and telephone numbers, are saved and, if necessary, passed on to our service partners within the framework of the order processing. (2) As a matter of course, all personal data are treated strictly confidential. In particular the data are not passed on to third parties as long as not required for the order and its processing. (3) By placing the order, the customer agrees to the saving of their personal data. 11. WarrantyUnless expressly otherwise agreed, the statutory warranty regulations are applicable. 12.
